New Year, New Laws: Complying with Virginia’s Updated Employment Laws
Virginia’s employment laws continue their evolution, with an array of new provisions taking effect on July 1. Among the changes that employers should keep in mind:
Reasonable accommodations: Any employer with more than five employees is now required by the Virginia Human Rights Act to provide reasonable accommodations for an employee with a physical or mental disability. While the accommodations process has typically been reserved for larger employers, now even very small businesses will need to familiarize themselves with the duties and rules that come with it.
Change in calculating overtime: As a result of the new Virginia Overtime Wage Act, the Commonwealth is no longer directly in line with the Fair Labor Standards Act when it comes to determining eligibility for overtime wages and how those wages are calculated. The Act’s changes may present particular headaches for non-exempt, salaried employees.
